ARE YOU A TRUCK DRIVER WHO APPLIED FOR EMPLOYMENT AND ERRORS IN YOUR BACKGROUND CHECK STOPPED YOU FROM GETTING A JOB?
Often truck drivers are denied employment because of errors in the Driving History and Criminal History portions of their report. These errors commonly include:
- Someone else’s record is mixed with yours due to having the same or similar name and for other reasons;
- Inaccurate reporting of driving related violations or reporting equipment failure as driving violations
A potential employer should give you the opportunity to dispute any errors in a background check before deciding to fire you or not hire you.
If you have not received a copy of the background check report from the screening company hired by the employer to create it, you have the right to see it so that you can dispute any errors reported in it with the screening company.
If you lost employment or an employment opportunity due to a “background check” report with errors you could not dispute or were denied a copy of this violates your rights as a consumer under the Fair Credit Reporting Act (“FCRA”) entitling you to money damages. Other laws may have been violated if you are a resident of Pennsylvania.
